Temporary Skills Shortage Visa (Subclass 482)

When you want to work in Australia temporarily for a sponsoring employer, you can apply for the Temporary Skills Shortage Visa (subclass 482) which replaces the 457 visa. You can even bring family members to Australia with you.

There are three steps to the application process:

  1. Sponsorship
  2. Nomination
  3. Applying for the visa.

Sponsorship

Before you can apply for the 482 visa, your employer must be an approved standard business sponsor. This is a three-step process and they must:

  1. Collect supporting documents.
  2. Lodge the application form and pay the $AU420 fee.
  3. When approved, it is valid for 5 years and you will receive a transaction reference number (TRN).

To be an eligible sponsor, your business must be either a:

  • Registered business operating in Australia.
  • Business not operating in Australia but either has contractual obligations or is planning to expand operations to Australia.
  • New business.

Collect supporting documents

As part of your application to become a standard business sponsor, you need to supply documented evidence that supports you are legally operating in Australia. This includes:

  • An Australian Business Number when your business is in Australia.
  • An Australian Registered Body Number if you are registered to operate in Australia but are overseas.
  • Evidence of your business registration in another country if you are not already operating in Australia.
  • A copy of your registered business name if you are a company or a franchisee, trust deeds or a joint venture agreement, or relevant information such as signatures on contracts.
  • Copies of financial, bank and Business Activity Statements for the last 12 months and tax returns.
  • Have no relevant unfavourable information against your business.

*This is not an exhaustive list and many other documents are required which is assessed on a case by case for employers.

Also, you must confirm in writing that your business either has a strong record or demonstrate a commitment to employing local people.

You are also required to declare that your business is not and will not be discriminatory during the recruitment process.

Lodge your standard business sponsor application form

Now all the relevant documents are ready, lodge your standard business application form and pay the $AU420 fee.

Receive approval

Once you receive approval, you will receive a TRN and you can use it to nominate and sponsor an employee for a 482 visa.

Nomination

Before you can apply for a subclass 482 visa, your sponsoring employer must lodge a nomination form with your name on it. Immediately after the employer lodges the nomination form, you can lodge your 482 visa application.

Nomination application requirements

Once you receive your TRN, you can nominate someone but you must also demonstrate your business:

  • Meets training requirements.
  • Needs to fill a position and have made every effort to employ an Australian citizen or permanent resident.
  • Has advertised the position.
  • Is offering the same terms and conditions as you do to Australian employees.
  • Pays a salary that meets the market rate.
  • Complies with Australian workplace and immigration law.

You will need to meet the following mandatory requirements as part of your nomination application:

  • Labour market testing
  • Training Levy
  • Salary level.

Labour market testing

As part of the nomination process you need to demonstrate you have tested the Australian labour market to show evidence you cannot find a suitable employee in Australia. This means you must advertise the job on the open job market in the following time frames:

  • Within four months immediately prior to lodging a nomination application.
  • Where there is a redundancy in the 4 months before lodging an application, you must have advertised after the redundancy.
Advertising the position

For labour market testing, your advertising must meet all of the following:

  • The ad must be in English and you must advertise in Australia, and it must include all of the following:
    • Have a title and describe the position, and you can advertise more than one job in the ad.
    • Experience and skills required.
    • The name of the sponsor or the recruitment agency you are using.
    • How much the salary is if is under $96,400; for example, $70,000 to $78,000.
  • You must publish at least two advertisements in any of the following ways:
    • On a professional recruitment agency website such as Seek or an industry specific website.
    • In print in newspapers or magazines that are nationally marketed and released at least monthly.
    • On your business website if you are an accredited standard business sponsor with a TRN.

Please Note: If you do not provide evidence of labour market testing when you lodge the nomination form, you will receive a refusal. No exceptions.

Skilling Australians Fund Levy

As the sponsor, you will need to pay a Skilling Australians Fund levy at the time of nomination. The levy is calculated per applicant and according to the number of years required for the visa as follows:

  • A small business with a turnover of less than $10 million will pay $1,200 per nomination year for a subclass 482 visa. A large business pays $1,800 per nomination year.
  • If the employee is applying for a four-year visa, you will have to pay the annual payments at the time of lodging the nomination form. This means a small business will pay $4,800 when lodging the form.

Salary level

The salary for the nominated position must be:

  • Above the Temporary Skilled Migration Income Threshold (TSMIT). The current TSMIT threshold is $53,900 plus superannuation and reviewed each year by the Department of Home Affairs (DOHA).
  • Within the market rate for the role to ensure the applicant will be paid the equivalent or in line with Australian employees in comparable roles.

There are some occupations that have caveats which set a minimum remuneration level that is well above the TSMIT.

Applying for the Visa

There are three streams associated with the subclass 482 visa. So you need to decide which one is suitable for the position you are migrating to Australia to work in. They have different occupation lists, so which stream you apply for will depend on the occupation list your position is part of. The three different steams are the:

  • Short-term stream
  • Medium-term stream
  • Labour market stream.

Short-term stream

The short-term stream subclass 482 visa will allow you to work in Australia for up to 2 years, and this can be extended to 4 years if an International Trade Obligation applies.

An employer can only sponsor an employee from overseas if their position is on the Short-term Skilled Occupation List.

The English requirement for the short-term stream is equivalent to an IELTS score of 5. This test is not applicable if you have a passport from the UK, Ireland, Canada, US or New Zealand, or if you have completed more than five years of education conducted in English.

The short-term stream visa fee is $AU1,265.

 Medium-term stream

The medium-term stream subclass 482 visa will allow you to work in Australia for up to 4 years and this can be extended. This visa also gives you the option to apply permanent residency after three years employment with the one employer.

An employer can only sponsor an employee from overseas if their position is on the Medium to Long-term Skilled Occupation List.

The English requirement for the medium-term stream is the same as for the short-term stream. You English must be the equivalent of an IELTS score of 5. This test is not applicable if you have a passport from the UK, Ireland, Canada, US or New Zealand or if you have completed more than five years of education conducted in English.

The short-term stream visa fee is $AU2,645.

Labour Agreement Stream

The subclass 482 labour agreement stream is suitable when you are a skilled worker and your employer has a labour agreement. These are developed between the employer and Australian Government.

This 482 visa type allows you to live and work in Australia for up to 4 years but it depends on the terms of the labour agreement.

The labour agreement stream visa fee is $AU2,645.

Can my family join me in Australia on the same visa?

Again, this is an individual situation we will assess. As there are time of application requirements that must be met, your employer will have to agree and acknowledge your family or partner on your visa as well.
